Removing Conditions from Marriage-Based Green Cards
If you successfully sponsored your spouse for a green card and have been married for fewer than two years, they will receive a “conditional” green card. This visa will expire after two years and you will need to take actions to “remove conditions.” In the 90-day window before the conditional green card expires, you and your spouse will need to submit a request to remove conditions to USCIS. You will have to provide evidence of your evolving relationship and attend another in-person interview with a USCIS official. These situations can become more difficult if a green card holder divorces their spouse before conditions are removed, but it may still be possible to receive a non-conditional green card.
If you need a competent attorney on your side to help you obtain a conditional green card or assist with your removal of conditions on conditional permanent residence, do not hesitate to call 832-370-0741 or contact us below for a free initial consultation.
Fiancée Visa (K-1 visa)
A FiancĂ©e Visa (officially known as K-1 visa) is a nonimmigrant visa that allows the foreign  fiancĂ©e of a U.S. citizen to enter the U.S. for the sole purpose of getting married. The foreign fiancĂ©e may enter the U.S. once a valid K-1 is issued. The K-1 visa permits the foreign fiancĂ©e to travel to the U.S. and marry his or her U.S. citizen sponsor within 90 days of arrival. Eligible children of K-1 visa applicants receive K-2 visas. The foreign fiancĂ©e will then apply for adjustment of status to a permanent resident with the Department of Homeland Security (DHS), U.S. Citizenship and Immigration Services (USCIS). Employment Authorization is also commonly applied for at this time with the Adjustment of Status. If the foreign fiancĂ©e does not marry the U.S. citizen or if he or she marries someone else other than the U.S. citizen petitioner, the foreign fiancĂ©e must leave the U.S. after 90 days.Â
